These Terms of Service ("Terms") govern your access to and use of IViewMedia ("Service"), operated by IViewMedia ("we", "us", or "our"). By creating an account or using the Service, you agree to be bound by these Terms.
Please read these Terms carefully. If you do not agree, you may not use the Service.
1. The Service
IViewMedia is a SaaS platform that enables real estate media companies and photographers to create branded property viewers. The viewers can include 3D tours, photos, floorplans, video, PDF documents, and live visitor statistics.
Access to the Service is provided on a subscription basis. The number of active viewers you may maintain at any time is determined by your subscription plan ("viewer slots").
IViewMedia is a marketing tool, not an archive. Viewer slots are intended for active listings. When a property is sold or a listing is no longer active, we encourage you to delete that viewer to free up your slot for a new listing.
2. Account Registration
To use the Service, you must register for an account. You agree to:
- Provide accurate, current, and complete information during registration
- Maintain the security of your password and accept responsibility for all activity under your account
- Notify us immediately of any unauthorised use of your account
- Not share your account credentials with third parties
You must be at least 18 years old and legally capable of entering into binding contracts to use the Service.
3. Subscriptions and Payments
3.1 Plans and billing
IViewMedia offers several subscription plans (Starter, Growth, Pro, Agency). Pricing and plan details are published on our website. All prices are excluding VAT unless stated otherwise.
Subscriptions are billed either monthly or yearly, depending on the plan you select. Yearly subscriptions are billed as a single annual payment and include one month free.
3.2 Payment processing
All payments are processed by Stripe. By subscribing, you agree to Stripe's Terms of Service. We do not store your payment card details on our servers.
3.3 Automatic renewal
Subscriptions renew automatically at the end of each billing period unless cancelled. You may cancel at any time via the subscription settings in your account.
3.4 Refunds
We do not offer refunds for partial billing periods. If you cancel your subscription, you retain access to the Service until the end of the current paid period.
3.5 Price changes
We reserve the right to change our pricing. We will notify you at least 30 days in advance of any price increase. Continued use of the Service after the effective date of a price change constitutes your acceptance of the new pricing.
4. Acceptable Use
You agree to use the Service only for lawful purposes. You may not use the Service to:
- Upload or distribute content that is illegal, defamatory, obscene, or infringes on third-party intellectual property rights
- Upload malware, viruses, or any code designed to harm or disrupt systems
- Attempt to gain unauthorised access to our systems or other users' accounts
- Use the Service for purposes other than real estate marketing and presentation
- Resell or sublicense access to the Service without our prior written consent
- Use automated tools to scrape, crawl, or extract data from the Service
- Modify, disassemble, decompile, reverse engineer, or otherwise attempt to derive the source code of the Service or any part thereof
- Build or benchmark a competitive product or service, or copy any features, functions, or design elements of the Service
5. Account Suspension and Termination
5.1 Suspension for misuse
We reserve the right to suspend or terminate your account immediately, without prior notice, if we determine at our sole discretion that you have:
- Violated these Terms or any applicable law or regulation
- Uploaded illegal, harmful, or infringing content
- Engaged in fraudulent activity or attempted to circumvent our billing systems
- Posed a security risk to other users or the platform
- Repeatedly exceeded usage limits or abused the Service in a way that degrades performance for others
In cases of serious or repeated violations, we may permanently ban your account and any associated accounts.
5.2 Cancellation by you
You may cancel your subscription at any time via your account settings. Upon cancellation, you will retain full access to the Service for the remainder of your paid billing period.
5.3 Grace period
After your subscription ends, you will receive a 15-day grace period during which your viewers remain accessible. We will send reminder emails on day 0, day 7, and day 14. After the grace period, all your viewers and associated media files will be permanently deleted.
5.4 Data after termination
Upon termination, we will delete your account data, viewer content, and media files from our servers. This action is irreversible. We recommend downloading any media you wish to retain before your subscription ends.
6. Content and Intellectual Property
6.1 Your content
You retain ownership of all content you upload to the Service (photos, videos, PDFs, logos, etc.). By uploading content, you grant us a non-exclusive, worldwide licence to host, store, and display that content solely for the purpose of providing the Service to you.
6.2 Our intellectual property
The IViewMedia platform, including its software, design, trademarks, and branding, is owned by us and protected by intellectual property law. You may not copy, modify, distribute, or create derivative works based on our platform without our express written permission.
6.3 Third-party content
You are solely responsible for ensuring that any content you upload does not infringe the intellectual property rights of third parties, including photographers, architects, and other rights holders.
7. Availability and Service Levels
We strive to maintain high availability of the Service, but we do not guarantee uninterrupted access. The Service is provided "as is" and we may perform maintenance, updates, or experience downtime from time to time.
We reserve the right to modify, suspend, or discontinue any feature of the Service with reasonable notice.
8. Limitation of Liability
To the maximum extent permitted by applicable law, IViewMedia shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, goodwill, or business interruption.
Our total liability to you for any claim arising from these Terms or the Service shall not exceed the amount you paid to us in the 3 months preceding the claim.
9. Changes to These Terms
We may update these Terms from time to time. We will notify you of material changes by email or via a prominent notice in the platform. Your continued use of the Service after the effective date of any changes constitutes your acceptance of the updated Terms.
10. Governing Law
These Terms are governed by and construed in accordance with the laws of the Netherlands. Any disputes arising from these Terms shall be subject to the exclusive jurisdiction of the courts of the Netherlands.
